COMPETITION REGULATIONS

 

Come up with a promotional slogan for HITZE brand fireplaces

§1. Definitions

The terms used in this regulation (hereinafter referred to as the 'Regulation') mean:
CONTEST' - a contest titled 'Come up with a promotional slogan for HITZE brand fireplaces', conducted in accordance with the rules specified in this Regulation.
ORGANIZER" - owner of the HITZE brand, company STALKO Limited Liability Partnership, 00-403 Warsaw, Solec 24/253 Street, Tax Identification Number (NIP) 9481990793, National Business Registry Number (REGON) 141434663.
PARTICIPANT' - an adult natural person with full legal capacity, who voluntarily enters their participation in the Contest.
CONTEST COUPON' - entry form for the Contest.
COMMITTEE' - Contest Committee consisting of representatives of the Organizer.

Section 2. General Provisions

This Regulation defines the rules and conditions of participation in the Contest.
The competition is conducted in the territory of the Republic of Poland, during the "Radom Expo 2023" fair event organized on September 8-9, 2023 in Radom, Struga 63, 26-600 Radom (hereinafter referred to as the "Fair").
The competition starts with the opening of the Fair on September 8, 2023 at 09:00 and ends on September 9, 2023 at 1:00 p.m. Applications for the Competition are accepted during the Fair.
English (UK): "The Contest is not a game of chance, a sweepstake, a mutual betting, a promotional lottery, the outcome of which depends on chance, or any other form of gambling provided for in the Act of 19 November 2009 on gambling (Journal of Laws of 2009, No. 201, item 1540, as amended).

Section 3. Conditions of Participation in the Contest

Any adult natural person with full legal capacity can participate in the contest, excluding individuals referred to in paragraph 2 below.
Employees of the Organizer, as well as members of their immediate families, are excluded from participating in the Contest. Immediate family members are considered to be ascendants, descendants, siblings, spouses, spouses' parents, cohabitants, adopted persons, and parents of such individuals.
Before participating in the Contest, the Participant should familiarize themselves with the Regulations.
The Contest Coupon must include a legible signature of the Participant confirming familiarity with these Regulations, consent to the processing of their personal data for the purpose of establishing the true identity of the Participant and awarding the prize, as well as an obligation to transfer copyright to the submitted contest works (promotional slogans).
Contest coupons are free of charge and are available at the Organizer's booth during the period indicated in § 2 para. 3 above.
Entries for the Contest, understood as the submission of a fully completed Contest Coupon, are accepted at the Fair at the Organizer's booth.
Participation in the Contest, as well as the rights and obligations associated with it, including the right to claim the prize, cannot be transferred to other individuals.
The Organizer is not responsible for the inability to submit a contest entry due to reasons beyond their control.

Section 4. Contest Rules

The contest participant must complete the Contest Coupon in its entirety, write their own promotional slogan on it, and provide contact information to establish their identity.
Each Participant can fill out a maximum of 3 (three) Contest Coupons, and only one prize can be awarded to each Participant.
The contest consists of a single stage.
Slogans containing content contrary to the law, violating social and moral norms, or not in line with the Contest's objectives (promotion of HITZE brand fireplaces) will not be considered, i.e., they will not be subject to evaluation by the Committee.
The Contest Participant declares that the slogans submitted in the Contest are an expression of their own creative activity and do not infringe upon any rights of third parties, including their personal rights. In the event that the submission violates any rights of third parties, including intellectual property and personal rights, the Participant will undertake to satisfy all claims made by third parties in connection with the violation of these rights, excluding obligations and liabilities within the scope of the Organizer's responsibilities as stipulated by applicable laws.

Section 5. Prizes

One winner will be selected in the Competition.
The main prize in the competition is the "RAVE" bio-fireplace worth PLN 550 (five hundred and fifty PLN) gross. 
Winners are not entitled to request the exchange of the Prize for another one or for a cash equivalent.
The winner of the main prize will receive the Prize through personal collection from the Organizer's headquarters in a previously agreed-upon timeframe, after providing necessary information, according to the provisions stated in §7 below, or by courier at the Organizer's expense, following prior submission of necessary address information. Other winners will receive their prizes by courier at the Organizer's expense, after prior submission of necessary address information. In the event of an incorrect address or Participant's data preventing successful prize delivery, as well as in the case of failure to claim the main prize within 30 days from the Contest's resolution date, despite proper notification of winning, the right to the prize expires

Section 6. Contest Resolution

After the end of the Competition, on September 9, 2023 at 1:00 p.m., the Committee consisting of the Organizer's representatives will select one winner ("Winner") among the Participants, whose entry will be rated highest by the Competition Committee. When assessing the competition slogans, the Competition Committee will take into account the creativity of the Participants, i.e. the author of the most interesting promotional slogan will be awarded.
The winners of the competition will be notified by phone and, in addition, the list of winners will be announced on the company profile on the Facebook social networking site. https://www.facebook.com/HitzeProducentKominkow and on the profile https://www.facebook.com/stalkocom within 14 days from the end of the competition. Participants agree to this form of notification.
The Organizer will establish the conditions and the date of prize collection with the winner of the main prize over the phone.

Section 7. Personal Data

In accordance with Articles 13 and 14 of Regulation (EU) 2016/679 of the European Parliament and of the Council
dated April 27, 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (EU Official Journal L 119/1 of May 4, 2016), hereinafter referred to as 'GDPR', Stalko sp. z o.o. sp.k. declares that:
The administrator of your data is Stalko sp. z o.o. sp.k., 00-403 Warsaw, ul. Solec 24/253, tax identification number (NIP): 9481990793, National Business Registry Number (REGON): 141434663.
The administrator has appointed a Data Protection Officer (DPO) responsible for overseeing the correctness of data processing within their scope. You can contact them at the email address: iod@stalko.com.
Your personal data will be processed by the Administrator in connection with the execution of the contest titled 'Create a Promotional Slogan for HITZE Fireplaces'. Personal data is processed based on your expressed consent, in accordance with Article 6(a) of the GDPR.
Personal data will be stored for the duration of the contest.
Personal data provided by the contest participant will be processed for the purpose of organizing, promoting, and conducting the contest, publishing information about the contest winners, as well as for archival and accountability purposes required by the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council, hereinafter referred to as GDPR.
Stalko sp. z o.o. sp.k. does not intend to transfer your data outside the European Economic Area.
You have the right to access your personal data and the right to rectify them, the right to request their erasure, the right to restrict processing, and the right to object to data processing.
Your personal data may be disclosed to other entities, including IT entities and entities authorized under the provisions of the law.
Entities (data processors) to whom Stalko sp. z o.o. sp.k. delegates tasks that may involve the processing of personal data may have access to your personal data.
Individuals whose personal data is processed by the Administrator have the right to file a complaint with the President of the Personal Data Protection Office (address: Urząd Ochrony Danych Osobowych, ul. Stawki 2, 00-193 Warsaw).
Providing personal data is voluntary but necessary to enable the Administrator to organize the contest and notify winners of prize awards.
The administrator does not process the personal data of contest participants solely through automated processing, including profiling.
The processing of personal data of participants will include the following scope of data:
Name and surname
email address,
Phone number
Participant's data and email address will be used only for the purpose of conducting the contest and awarding prizes.
Refusal by the contest winner to provide the data specified in section 5 above may result in the refusal to issue the prize.

Section 8. Violation of the Regulations

Any violation of the Contest Regulations prevents the participant from further participation in the contest. The decision in this matter is made by the Organizer.
Violation of the Regulations is understood, in particular, as:
Providing false or incorrect personal data;
Submission of a competition entry that violates §4 para. 3 and 4 of the Regulations;
An attempt to unlawfully influence the course of the Competition - especially through threats, fraud, and coercion.
The decision to exclude from the Competition will be communicated to the excluded Participant through the contact method provided by them. The Organizer's decision is binding and final.

§9. Copyright

The regulations will be available on the website at: www.hitze.pl/konkurs
By participating in the competition, the Participant declares that they are the author and possess the proprietary copyright to the work they are submitting in the competition, and that these rights do not infringe upon the rights of third parties.
The submission of competition entries is equivalent to the free transfer of all proprietary copyright to the Organizer for the use of the submitted works or their parts in all fields of exploitation, including:
In terms of fixation and reproduction of the work - production of copies of the work using specific techniques, including printing, reprographic, magnetic recording, and digital techniques; in terms of trading in the original or copies containing the work - putting into circulation;
In terms of disseminating the work in a manner other than specified above - public performance, exhibition, display, reproduction, broadcasting, and rebroadcasting, as well as public provision of the work in such a way that everyone can access it in a place and at a time of their choosing.
The author gives consent for the publication on the website, social media, and other electronic and traditional media by the Organizer of the submitted work, as well as for the use of the work for promotional purposes of the Organizer.
Each time along with the transfer of proprietary copyright, without the need to submit any additional statements, the Organizer is authorized to exercise derivative copyright to the work subject to transfer, i.e., the right to allow disposition and use of adaptations, as well as authorizing third parties to exercise derivative copyright to such a work. The Participant does not retain the right to exercise derivative copyright.
The winner of the Competition, based on Article 921 § 3 of the Civil Code, upon being awarded the prize in the Competition, shall transfer to the Organizer the proprietary copyright to the works contained in the competition entries, within the fields of exploitation known on the day of the transfer of rights, especially as indicated in the preceding paragraph, and additionally in terms of derivative rights. The scope of the license referred to in paragraph 2 shall apply accordingly to the transfer of rights.6. Individuals submitting competition entries grant the Organizer the authorization to exercise on their behalf the personal moral rights regarding the works recorded in the competition submission, including, in particular, making decisions about the first distribution of the work.7. The Organizer is obliged to respect the personal moral rights of the Competition Participants and to attribute authorship to the competition works when using them.

Section 10. Final Provisions

Contact with the Competition Organizer regarding all matters related to it is possible through traditional mail at the address indicated in § 1 para. 2 of the Regulations or at the following email address: info@hitze.pl
All content contained in advertising or promotional materials related to the Competition is for informational purposes only. The provisions of this Regulation and the applicable legal regulations hold legal force.
Complaints regarding matters related to the Competition should be submitted in writing, along with a justification, to the Organizer at the addresses indicated in § 1 para. 2 of the Regulations within three days from the end of the Competition – personally or by registered mail (in this case, the date of the postmark determines the consideration of the complaint). Complaints submitted after the above-mentioned deadline will not be considered. The Organizer will review complaints within 10 (ten) days from the date of their receipt and will inform the Competition participant of the outcome in writing sent to the address provided in the complaint. The Organizer's decision regarding the complaint is binding and final.
In justified cases, the organizers may amend the Regulations in the form of annexes.
In matters not regulated by the Regulations, the relevant provisions of Polish law shall apply, in particular the provisions of the Civil Code and the Copyright and Related Rights Act.
Both the Competition Participants and the Organizer will seek to resolve any disputes arising from the Regulations of the Competition amicably, through negotiation.

Any disputes regarding the Competition that cannot be resolved amicably will be settled by the competent court of general jurisdiction for the Organizer's registered office.
